By using the information on this website and or making a purchase from this website you automatically agree that you have read, understand and are bound by the terms herein. If you do not accept these terms in their entirety, DO NOT USE THIS WEBSITE.
Because of the logistics of the industry, as legitimate sellers, we cannot accept returns under any circumstances, as we would not be able to sell the numbers again without risk.
Simplicity Software, Inc., incorporated in Florida in 1990, through barcodesimplicity.com ( “Website”) :
- Provides barcode number (“GTIN” ) information. This information is not legal or business advice and, because of the changing nature of e-commerce, we cannot guarantee that it will always be current nor accurate . We do not make any suitability for purpose warranties. The Website is merely one of the many sources you should consult prior to making an intelligent decision to meet your GTIN requirements.
- Sells assignments to the GTIN licenses it obtained directly from UCC (now GS1)
Simplicity Software, Inc. (“Simplicity”) warrants that:
- You will be issued unique, never used before, barcode number(s) (“GTIN”) which were originally issued to Simplicity by UCC (now GS1) prior to 2003. You are not buying the rights to a GS1 prefix, only specific numbers from that prefix.
- The GTINs and their respective licenses are perpetually assigned to you. Their license will never expire and you have full rights to do as you please with them, forever.
- The GTINs are not subject to any additional fees, licenses, nor renewal fees.
- Your information will not be sold nor shared with any third party.
Simplicity makes no other warranties or representations and is not entering into any contractual obligation beyond ensuring that a legal and binding perpetual GTIN assignment is consummated.
- It is your responsibility to confirm that our GTINs are acceptable to the retailers / wholesalers to / through whom you will be selling and that the GTINs meet any specifications or restrictions required by those retailers BEFORE YOU PLACE YOUR ORDER WITH US.
- Simplicity will not be liable for any damages that arise out of the use of the assigned GTINs.
- Simplicity’s liability, under any circumstances, will not exceed the amount you paid for the GTINs.
- You will hold Simplicity, and all entities involved in your dealings with Simplicity, including, but not limited to, its employees, contractors, agents, directors, officers, and assigns, harmless from any and all loss, damage, expenses, claims, suits, proceedings, actions and causes of action of any kind and nature arising out of your use of the Website, the information contained on the Website or any GTINs purchased.
This Terms of Service agreement will:
- be automatically modified to make any unenforceable part valid
- have any claim, dispute or breach thereof be decided exclusively by arbitration
- be governed by the laws of the State of Florida
- have any arbitration held in Fort Lauderdale, Florida
- have any cause of action commenced within two (2) years of its accrual
- have its terms survive all parties and shall continue indefinitely
